New Delhi: On Friday the Supreme Court sought a response from the Maharashtra and Assam governments regarding a plea filed by YouTuber Ashish Chanchlani who was seeking to either quash or transfer the FIR registered against him in Guwahati to Mumbai.
An FIR was filed in Guwahati against the YouTuber after a video of Samay Raina’s viral show India’s Got Latent came under fire for promoting obscenity.
The bench of Justices Surya Kant and N Kotiswar Singh issued a notice and tagged Chanchlani’s plea with influencer Ranveer Allahbadia’s pending petition.
The bench told Chanchlani’s counsel that he was already granted bail in the matter.
Appearing for Chanchlani, his counsel admitted that their client had gotten relief but Chanchalani was against the lodging of multiple FIRs in different cities.
The bench said that it was already hearing the issue and tagged Chanchlani’s plea along with Allahbadia’s plea.
It is important to note that on February 18, the apex court granted interim protection from arrest to podcaster Ranveer Allahbadia for his obscene comments on Raina’s YouTube show calling them "vulgar".
The Gauhati High Court on Tuesday granted interim bail to Chanchlani while hearing his anticipatory bail petition and asked him to be present before the investigating officer within 10 days.
The FIR was registered by the Guwahati Police on February 10, based on a complaint from an individual. The complaint cited various sections of the Bhartiya Nyay Sanhita (BNS), Information Technology Act, Cinematograph Act, and Indecent Representation of Women (Prohibition) Act.
